Imagine if it happened here, and they gunned down any kid that ran from the police? How many of us would still be around - I know I'd be dead.

Its not "any kid" though. It is because he was Black. I've been pulled over by police for speeding and they didn't treat me anything like this

Oh no I know, it’s just the way these people who say “if they didn’t run they wouldn’t get shot” act like it would happen to white kids as well, when they know it wouldn’t, and if it did, they’d definitely have something different to say.

Its so disingenuous. Its hard to even argue with people like that, since their arguments aren't in good faith

These arguments puzzle me as well. Like, no wonder he was resistant to being apprehended - she immediately escalated the situation by pulling out a GUN. I also think the chances of the routine traffic stop in the first place would have been cut in half had he been white. There are so many layers to this that require reform and accountability.

Kim Potter has been charged with second degree manslaughter. @POP! knows more about what that means than me but manslaughter doesn’t seem like enough to me

I think they can amend the charge as evidence surfaces, but I don’t think there is any indication of “malice” necessary for an upgrade to murder yet. And I’d hate for there to be a non guilty verdict if they overshoot.

Her uttering “oh shit I shot him” would be admissible hearsay on a few grounds I think and probably defeat any “murder” charge.

This NYT story found that in 15 previous cases of an officer "mistakenly" drawing their gun rather than a taser across the last 20 years, only 5 were brought to trial and in the end 3 convicted.

looked at another way, I suppose that implies a 60% chance of a guilty verdict based on previous cases when this does go to trial.

I'm actually surprised it's as high as 3 of them being convicted.

It still astonishes me that any officer is going for ANY kind of weapon (taser OR gun) in the situation of a car with out of date plates or similar. It's just a completely different world over there.

Right, and I'm a bit rusty on my constitutional/criminal law, but I would wager the use of any weapon to apprehend a suspect with an arrest warrant for a non-violent crime (weed... which is now decriminalized in that jurisdiction anyway for the amount he had on him) is a BIT unreasonable and cruel.

Have you heard the latest one, with a 13 year old boy gunned down by police in Chicago?

There’s bodycam footage but I can’t click on it.

I've seen a still, I am absolutely not watching it. Interesting to see how the apologists deal with it. And when I say "interesting", I mean it will be thoroughly depressing, seriously frustrating and a display of wanton, stubborn ignorance because it always is.

"He feels horrible about the outcome. He feels horrible he had to use deadly force. No police officer wants to use deadly force in the line of duty. He was well within his justification of using deadly force, he just feels horrible

How can you say something like this with a straight face (as a LAWYER) when it’s plain to anybody with eyes that it’s obviously a perk of the job to most of these psychopaths.

I think it's more complicated than them being psychopaths, although they're certainly not short on trigger-happy dickheads. But it's also the way the police are trained to perceive these neighborhoods and their residents. Like they're wild animals that need to be tamed. It's such a sick attitude.

Body cam footage of the shooting of a thirteen year old Adam Toledo in March has surfaced...

Can we have a poll?

2nd degree murder
3rd degree murder
2nd degree manslaughter
full acquittal

What do you reckon?

I'm struggling with the difference between those three terms to be honest. I think they'll find him guilty of one of the lesser offences though. Almost like throwing the public a bone.

Yeah I’m thinking manslaughter to try and straddle the fence.

Here’s more on the meaning of the charges:

The second-degree unintentional murder charge alleges Chauvin caused Floyd's death "without intent" while committing or attempting to commit felony third-degree assault. In turn, third-degree assault is defined as the intentional infliction of substantial bodily harm.

The third-degree murder charge alleges Chauvin caused Floyd's death by "perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life."

The second-degree manslaughter charge alleges Chauvin caused Floyd's death by "culpable negligence whereby the person creates an unreasonable risk, and consciously takes chances of causing death or great bodily harm.

Washington Post saying it'll be at the top of the hour so about 10 minutes.

Regardless of the result I don't see much changing. If he's acquitted he'll be looking over his shoulder for the rest of his life, if he's in prison, he'll be protected and shielded from other prisoners who will kill him.

I don't think it's about Chauvin now. The verdict is bigger than the accused here. The film footage is out there and has been since the beginning.
